			<content:encoded><![CDATA[<p>Now that the tech industry’s nerds have gotten their revenge against Hollywood’s bid to pass anti-piracy legislation, don’t look for a sequel in 2012.<br />
Congress scuttled consideration of the bills last month after widespread Web protests on Jan. 18, when viral unrest, led by Google’s blacked-out logo, spooked legislators into abandoning their support for the House’s Stop Online Piracy Act (SOPA) and the Senate’s Protect Intellectual Property Act (PIPA).<br />
“These bills are politically toxic now. It’s unlikely that a new bill will be introduced in an election year,” said Helen Brunner, director of the Media and Democracy Fund, which opposed SOPA and PIPA.</p>
<p>The poisoning in political support was, in some cases, a dramatic display of lobbying dollars going down the drain. Freshman Sen. Roy Blunt (R-Mo.), for instance, received $150,000 from music and movie companies in 2010 and just $60,000 from the tech industry. Nevertheless, Blunt withdrew his co-sponsorship of PIPA before the blackout day was even over.<br />
MPAA chairman and former Connecticut Sen. Christopher Dodd gave a warning to turncoat legislators his industry helped with donations.<br />
“Don’t make the false assumption this year that just because we [donated] in years past that we’re going to do it this year,” Dodd told Fox News.<br />
Nevertheless, the defections in Congress showed that Web companies could amplify their millions of lobbying dollars by telling users about legislation they oppose.</p>

Those CNodes were established back in 2003 and most of them are no longer online. If one of these nodes are online, you can make the initial connection and you&#8217;re fine. But if not, there&#8217;s nothing you can do but try later. </p>
<p>New users are frustrated to wait hours before they realize their version of Ares doesn&#8217;t connect! It&#8217;s kind of like playing the slot machine &#8211; sometimes you hit the jackpot, and sometimes you just waste your time. </p>
<p>Fortunately, Ares Vista includes the AresConnect utility that uses a different connection method which ensure instant connection to the Ares Network. <p>New in 2011<br />

			<content:encoded><![CDATA[<p>The issue of digital policies is yet to be the platform where the current Canadian election campaign is being played but most interestingly, it has not been ignored. It has been well noted that it is the first time ever all the flag bearers among the political parties are devoting a huge part of their time on aspects of digital policies, with the New Democratic Party and the Liberals running events looking into digital policy. There has been a general agreement among the parties on some issues, such as the pricing of the Internet and its access, copyright, privacy and security balance and competition of telecommunication. Each of the parties has a set of surprises giving an insight on their perceived priorities on digital policy.</p>
<p>Conservatives</p>
<p>The Conservatives have the least detailed digital policy platform, mostly alluded to their record in the last fiver years. Other parties have a more detailed approach, with a significant number of its perceived positions clearly re-affirming its goal of being on course towards funding the distinct rural broadband investments plus the re-introduction of the copyright reform Bill C-32. They have also been very vocal in their opposition to implement the iPod tax.</p>
<p>A surprise by the Conservatives is that of veering from their stress on the economy to concerns of digital security. The Tories for instance have very less to say concerning the removal of barriers on foreign ownership in the case of telecom companies or even their intention after receiving the spectrum auction proceeds. Enforcing these policies by the New Democrats would clearly call for the right reforms to be subjected to the Act of Broadcasting, forcing a reopening by the CRTC a decision on new media to allow hands-off internet regulation path to be followed.</p>

			<content:encoded><![CDATA[<p>An elephant named Amazon Cloud Drive just entered into the already crowded room that is online music sharing.    Of course it makes perfect sense that Amazon.com would seek a piece of this massive pie, since they already have the most sophisticated online content delivery systems in place for their bookstore.  Not too mention the huge customer base, state of the art shopping cart systems, AND a huge war chest of funds that will come in handy to battle the thousands of very aggressive lawyers employed by the recording industry.  </p>
<p>Strangely enough, the current leader in online music downloads, Apple computer, is thought to be a beneficiary of this latest move.  Confused? So were we.<br />
The thinking is that Amazon will break the ground with the first widespread online content locker, and apple will soon follow with a superior service and control of the storage devices that 69% of online music lovers already use.  </p>
<p>Amazon told All Things Digital that it doesn&#8217;t need licenses for music storage. What is less clear is whether or not it need licenses for streaming. (In fact, the labels themselves do not seem to be clear on that either.) Insiders told Reuters that unlicensed streaming might be illegal; in 2007, a similar storage locker service was sued by EMI for copyright infringement. EMI didn&#8217;t win, but the mere threat of the label litigation seems to have kept many from pursuing lockers. </p>
<p>Obviously it makes great business sense for Amazon to go after this market, but the ancillary benefit could be huge. Amazon is one of just a handful of companies with the resources to stand up to the music industry on this one. Like we said, sit back and enjoy.</p>

			<content:encoded><![CDATA[<p>Davenport Lyons were the first in a long line of lawyers to realize just how lucrative it would be to target people with pay-up-or-else letters threatening legal action for alleged file sharing. Way back in 2007 they first came into the public eye with a landmark case against a woman accused of illegal file sharing and it was not long before other firms of lawyers saw the benefits of pursuing similar claims.</p>
<p>Unfortunately for Davenport Lyons, documents have now come to light which prove they were fully aware all along that the evidence they were using against people was flimsy at best and very unlikely to stand up to serious scrutiny. Of course the cases were never intended to be taken to court as the simple generic letters were designed to scare innocent people into paying up rather than risk expensive litigation.</p>
<p>The Solicitors Regulatory Panel has now decided that Davenport Lyons has breached the code of conduct expected of solicitors and as such has referred the case against two of Davenport Lyons partners to the Solicitors Disciplinary Tribunal next year. The hearing will go ahead in May and will last approximately 7 days.</p>

			<content:encoded><![CDATA[<p>The judge at the centre of the much publicised ACS:Law and MediaCAT copyright infringement case recently heard at the Patents County Court, finally delivered his scathing judgement on Wednesday 9th February. </p>
<p>There were more than seventeen thousand words of criticism against the two protagonists responsible for a catalogue of speculative invoicing cases, but as well as the long litany of criticisms against Andrew Crossley and his partner in crime, MediaCAT, the judge raised a few issues that could have serious implications for the Digital Economy Act in the UK.</p>
<p>Judge Birss commented that monitoring done to identify an IP address as part of a copyright infringement exercise cannot possibly identify whether an infringement has actually taken place given the widespread use of Internet routers. This technicality is crucial to the Digital Economy Actsomething that will probably be discussed at a planned judicial hearing next month following applications by leading ISPs BT and Talk Talk.</p>
<p>The ruling could have serious repercussions on future speculative invoicing scams carried out by other greedy law firms in the anti piracy arena who are seeking to make an easy profit, of which there are still a few left despite the humiliations suffered in recent months by ACS:Law.</p>

			<content:encoded><![CDATA[<p>After seeing their insurance rates rise from 15,000 to a crippling 120,000 following the disastrous leak of confidential information on to the Internet, it is no wonder that solicitor Andrew Crossley , owner of ACS:Law, has decided to call it a day. In the last few months, Andrew Crossley has faced an ever-increasing barrage of criticism from the public, consumer bodies, and finally the courts.</p>
<p>This week, ACS:Law was back in court yet again, along with its anti piracy partner, MediaCAT, in the hope that it could persuade the judge to discontinue the 26 file sharing cases currently making their way through the judicial system at the Patents County Court in the UK. Both parties are fully aware that if the cases are withdrawn, ACS:Law can continue sending &#8216;pay up or else&#8217; letters to extract more money.</p>
<p>But since the judge was apparently even less amused at the extent of the shenanigans displayed by ACS:Law, Andrew Crossley has apparently decided to throw the towel in and call it a day. However, he still has the disciplinary hearing to face in a few weeks, so his woes are not completely over.</p>

			<content:encoded><![CDATA[<p>Alleged file sharers can finally rest easy in the wake of the news that anti piracy firm, ACS:Law, has decided to call it a day and close down their business activities for good. Along with MediaCAT, ACS:Law&#8217;s partner in the much criticised &#8220;speculative invoicing&#8221; business, Andrew Crossely has not only ceased all of his file sharing related activities, he has also completely shut his law firm down as of 31 January 2011.</p>
<p>This surprise announcement comes hot on the heels of the last disastrous court appearance from Andrew Crossley. The judge who presided over the twenty seven cases against alleged file sharers brought to the Patents County Court by ACS:Law and MediaCAT was immensely critical of the way the two businesses had handled the whole affair and they now facing an application from the court for &#8220;wasted costs&#8221;.</p>
<p>Since ACS:Law is not a limited company, it is extremely likely that Andrew Crossley will now face claims for costs from the defendants of the various file sharing claims brought by ACS:Law and MediaCAT. And since he will be personally liable for any costs, it could prove disastrous for the man who thought he could make millions on the back of speculative invoicing.</p>
